China’s Digital Security Law: Prospects and Recommendations

In September 2021, China adopted its new Data Security Law (DSL) — one of three laws aimed at maintaining China’s data sovereignty. The other two are the Cybersecurity Law and the Personal Information Protection Law. Inter alia, businesses operating within China must now familiarise themselves with these new policies aimed at protecting Chinese citizens. This paper outlines the meaning of data sovereignty, discusses China’s DSL, and concludes with recommendations for further improvements of China’s data regulatory framework.
